Beautiful Chaos Photography – Session Agreement & Terms of Service

This agreement is entered into between Beautiful Chaos Photography (referred to as "Photographer") and the undersigned client (referred to as "Client") for photography services on the agreed date.

1. Package Inclusions

All packages include a minimum of 50 fully edited digital images per hour hired. Additional travel fees may apply depending on the session location.

2. Venue Fees

If the Client selects a venue that requires an entry fee, rental fee, or permit, the Client is solely responsible for all such costs. The Photographer is not liable for securing or paying for venue access.

3. Deposit and Payment Terms

A non-refundable deposit of $500  which is required at the time of booking to reserve the date. The remaining balance must be paid in full before or on the day of the photo session.

5. Cancellation & Rescheduling

• Cancellations: Deposits are non-refundable. Cancellations made within 48 hours of the scheduled session may incur additional cancellation fees.

• Rescheduling: Sessions may be rescheduled due to weather, illness, or emergencies, at the Photographer’s discretion. One complimentary reschedule is allowed if notice is provided at least 48 hours in advance. Additional reschedules may be subject to a fee.

6. Printing Quality Disclaimer

The Photographer cannot be held responsible for the quality of prints made at printing labs not recommended or affiliated with the Photographer. It is strongly encouraged that prints be ordered through the Photographer’s preferred professional lab to ensure quality and color accuracy.

7. Copyright & Image Usage

All images remain the copyrighted property of Beautiful Chaos Photography. The Client is granted a personal, non-commercial license to use the images. Images may not be altered, sold, or used for commercial purposes without written consent from the Photographer.

Unless otherwise requested in writing, the Client grants the Photographer permission to use images for promotional purposes, including social media, website portfolio, and marketing materials.

8. Indemnification

The Photographer is under no obligation to capture any specific moment, pose, or individual during the session. The Client agrees to the following indemnification terms:

• If the Photographer is unable to perform due to illness, accident, or causes beyond their control, all fees paid will be refunded in full, and the Client agrees to indemnify the Photographer from any further liability.

• The Client holds the Photographer harmless in cases of technological failure, including but not limited to data loss.

• The Photographer is not required to retain images longer than 60 days after delivery.

• The Client agrees to hold the Photographer harmless for personal injury that may occur during the session.

• The Photographer will deliver work in a professional and workmanlike manner, but is not obligated to meet specific aesthetic preferences.

9. Duty of the Client

The Client is responsible for obtaining all permissions needed for photography at the session location (e.g., churches, event venues, private properties). Any failure to obtain proper permissions that results in fines or denied access is the sole responsibility of the Client.

10. Exclusive Photographer

The Client agrees that no other photographers (amateur or professional) may interfere or duplicate poses, setups, or compositions during the session. The Client is responsible for ensuring guests or bystanders do not obstruct or impede the Photographer’s work.

11. Accident Waiver and Release of Liability

By participating in a session or event, the Client agrees to the following:

• I acknowledge and accept all risks of injury, illness, or property loss during the photography session or related activity.

• I waive, release, and discharge Beautiful Chaos Photography and its owners, staff, representatives, volunteers, and affiliates from any and all liability for damages or claims arising from my participation.

• I agree to indemnify and hold harmless the Photographer from any claims resulting from my participation, whether caused by negligence or otherwise.

• I consent to medical treatment in case of injury during the session.

• I understand that flash photography may be used and agree that my likeness may be captured and used for legitimate promotional purposes by the Photographer

• This waiver and release shall be construed broadly to provide a release to the maximum extent permissible under applicable law.

Acknowledgment and Agreement
By booking a session and submitting payment, the Client agrees to all terms outlined in this agreement. This document serves as a binding agreement between the parties.
